These Terms of Service apply when you use vorairs.com or buy from VORAIR. By using our site or placing an order, you agree to them. Our Shipping Policy, Refund Policy and Privacy Policy form part of these terms.

1. About us

This site is operated by VORAIR, based in Mississauga, Canada. In these terms, "we", "us" and "our" mean VORAIR, and "you" means the person using the site or placing an order.

2. Who can buy

You must be the age of majority where you live to place an order. Our products are sold for personal use. We may cancel orders that appear to be placed for resale.

3. Our product

VORAIR Flow is a wearable personal cooling fan. It moves air across your body so sweat evaporates faster, which is what makes you feel cooler.

It does not lower the temperature of the air around you. It is not an air conditioner, and it does not filter, purify or condition the air. It is not rated as waterproof, and it is not a medical device. Nothing on this site is a health or medical claim, and VORAIR Flow should not be relied on to prevent or treat heat-related illness.

A USB charging cable is not included. Product photos are illustrative, and colours may look different on your screen.

4. Safe use

  • Follow the instructions supplied with your fan.
  • Keep hair, fingers and loose clothing away from the fan's openings while it is running.
  • Keep the fan away from rain and standing water.
  • Do not open, puncture, crush or modify the fan or its built-in lithium battery.
  • Charge it with a standard USB power source, and do not charge it in direct sun or a hot vehicle.
  • It is not a toy. Keep it out of reach of young children.

5. Prices and availability

All prices are in Canadian dollars unless stated otherwise, and may change without notice. Products are subject to availability.

If a product is listed at the wrong price or with the wrong description, we may correct the error and cancel any order placed with it. If we cancel your order for this reason, we will tell you and refund you in full.

6. Orders

When you place an order, you are offering to buy the product. We may accept or decline any order, and we may limit quantities. If we cancel an order after you have paid, we will refund you in full.

7. Payment

Payments are processed securely through Shopify. We do not store your full card details. By paying, you confirm that you are authorised to use the payment method you provide.

8. Shipping, returns and refunds

Delivery is covered by our Shipping Policy. Returns, refunds and cancellations are covered by our Refund Policy.

9. Your rights as a consumer

Nothing in these terms limits any rights you have under consumer protection law that cannot legally be excluded, including rights under Ontario's Consumer Protection Act, 2002 and the equivalent laws where you live.

10. Intellectual property

All content on this site, including text, images, graphics, logos, and the VORAIR name and marks, is owned by or licensed to us. You may not copy, reproduce or distribute it without our written permission.

11. Acceptable use

You agree not to misuse this site. That includes trying to gain unauthorised access to it, interfering with how it works, submitting false information, or using it to send malicious code.

12. Content you send us

If you send us reviews, photos, comments or suggestions, you confirm they are honest and your own, and you allow us to use and publish them in connection with VORAIR. We will not edit a review in a way that changes its meaning.

13. Third-party links

This site may link to websites we do not control. We are not responsible for their content, policies or practices.

14. Limitation of liability

To the extent permitted by law, our total liability to you for any claim related to your purchase is limited to the amount you paid for the product concerned. We are not liable for indirect or consequential losses. This section does not limit any consumer rights that cannot legally be excluded.

15. Indemnity

You agree to compensate VORAIR for claims or losses caused by your breach of these terms or your violation of any law or the rights of another person.

16. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes will be heard by the courts of Ontario, unless the consumer protection law where you live gives you the right to bring a claim there.

17. Changes to these terms

We may update these terms from time to time. The version posted on this page, with the date at the top, is the version that applies.

18. If part of these terms is invalid

If any part of these terms is found to be unenforceable, the rest of the terms still apply.
